Terms of Service

These Terms of Service ("Terms") govern your use of the interactive video platform operated by Playvios ("we", "us", or "our"), including our website at playvios.com and our mobile application (the "Service"). By creating an account, purchasing coins, or using the Service in any way, you agree to these Terms.

If you do not agree with any part of these Terms, please do not use the Service. If you are a consumer, mandatory consumer-protection laws in your country of residence still apply and are not limited by these Terms.

1. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction, whichever is higher) to use the Service, consistent with the age rating shown on the app store. If we offer creator monetization or withdrawal features, you must be at least 18 years old (or the age of legal majority) and complete identity verification (KYC) before you can receive any payout.

2. Description of the Service

Playvios is an interactive video platform. You can watch stories where your choices shape the plot, unlock episodes or storylines with virtual coins, and — if you choose — create and publish your own interactive stories using our creation tools. The Service is provided "as available"; we may add, change, or remove features at any time, and will give reasonable notice where changes materially affect paid features.

3. Your Account

• You may register with an email address, a phone number, or Sign in with Apple. You are responsible for keeping your credentials secure.
• You must provide accurate information and may not impersonate anyone or use an offensive display name.
• You are responsible for all activity under your account. Notify us immediately at q171005@163.com if you suspect unauthorized use.
• One person may hold one account. Accounts are non-transferable.

4. Virtual Coins, Purchases, and Refunds

4.1 Coins and AI Credits

Coins (and, where offered, AI Credits) are a virtual currency used within the Service to unlock stories, episodes, features, or AI-assisted creation. Important:

• Coins and AI Credits are a limited license to access features and computing resources. They are not money and not a stored-value, prepaid, or electronic-money instrument; they have no cash value and cannot be exchanged, transferred, sold, or refunded for cash except as required by applicable law.
• Coins and AI Credits remain valid while your account is active. Coins purchased do not expire.
• We may adjust what coins unlock or how credits are consumed, but we will never retroactively remove access to content you have already unlocked.

4.2 How You Buy Coins

• On the website: purchases are processed by Creem, which acts as the Merchant of Record (legal seller) for website transactions. Your payment is governed by Creem's terms and refund policy in addition to these Terms. Creem supports international cards and, where available, other local payment methods.
• On the iOS app: purchases are processed by Apple In-App Purchase. Apple's terms apply, and refunds for iOS purchases must be requested from Apple (reportaproblem.apple.com).
• PayPal, where offered on the website, is subject to PayPal's buyer protections.

4.3 EU / UK Consumer Right of Withdrawal (Digital Content)

By clicking "Purchase" (or equivalent) you confirm: (a) you agree that delivery begins immediately; (b) you acknowledge that you lose the right to withdraw once the coins have been credited. We collect this consent and acknowledgement at checkout before payment, and we confirm the contract to you on a durable medium (for example, an email receipt) afterwards, as required by EU and UK consumer law. If you made a purchase by accident (for example, a duplicate order), contact us within 14 days and we will review the case — we may issue goodwill refunds at our discretion where no content has been consumed.

4.4 Refund Policy

• Unused coins may be refunded within 14 days of purchase upon request, at our discretion, where permitted by the payment provider's rules and applicable law.
• Once coins have been spent (used to unlock content), that portion is non-refundable.
• iOS refunds are handled exclusively by Apple. Website refunds are handled by Creem (as Merchant of Record) or by us, depending on the payment method.
• Nothing in this section limits rights you have under mandatory consumer-protection law in your jurisdiction.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Upload, publish, or share content that is illegal, infringing, pornographic (in violation of our content rules), or that promotes violence, hatred, or self-harm;
• Harass, threaten, or defame other users or our team;
• Attempt to hack, scrape at scale, overload, reverse-engineer, or interfere with the Service, or bypass payment, access controls, or copy protection;
• Resell, sublicense, or commercially exploit access to the Service without written permission;
• Use automated scripts, bots, or tools to interact with the Service without our consent;
• Circumvent regional availability or age restrictions.

We may suspend or terminate accounts that violate these rules, and may delete offending content. Serious violations (e.g., payment fraud) may result in permanent bans and forfeiture of unused coins.

6. User-Submitted Content

If you create or publish stories, scripts, or other content on the Service:

• You keep ownership of your content. You retain all rights.
• You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt (for technical delivery, e.g., transcoding video formats), and display your content solely to operate and promote the Service (e.g., public story previews). This license ends when you delete your content, except for copies required for backups and legal compliance.
• You confirm you hold all necessary rights to what you upload, including music, footage, and AI-generated elements.
• You are solely responsible for your content. Do not upload content you do not have rights to.

6.1 Copyright Complaints (DMCA)

If you believe content on the Service infringes your copyright, send a notice to q171005@163.com including: (a) identification of the copyrighted work; (b) the URL or location of the infringing content; (c) your contact information; (d) a statement of good-faith belief; and (e) a statement, under penalty of perjury, that the information is accurate and you are the copyright owner or authorized to act. We will remove infringing material promptly upon valid notice. Repeat infringers will have their accounts terminated.

7. AI-Generated Content

• Some content on the platform may be created with generative AI tools. We label AI-generated or AI-manipulated content in accordance with applicable transparency rules (including the EU AI Act).
• If you use our AI-assisted creation tools, you are responsible for the prompts you provide and for ensuring the generated output complies with these Terms and applicable law. Do not use AI tools to create content that impersonates real people without consent, or that violates Section 5.
• We do not use your content or personal data to train AI models without your separate, explicit consent. See our Privacy Policy, Section 4.

8. Intellectual Property

The Service itself — including the platform code, design, our name and logo, and stories/content produced by us or our licensors — is protected by intellectual property laws and belongs to us or our licensors. Nothing in these Terms transfers ownership of our platform or our content to you. You may not copy, redistribute, or create derivative works from platform content except as the Service's features explicitly allow (e.g., sharing a link to a story).

9. Third-Party Services and Payments

• Payments are processed by Apple (in-app purchases), Creem (website Merchant of Record), and PayPal (where offered). Each provider's terms and privacy policy apply to your use of their services.
• We are not responsible for third-party services linked to or embedded in the Service.
• Where Creem acts as Merchant of Record, Creem is the seller of record for tax purposes, handles applicable sales taxes/VAT, and may contact you regarding your order.

10. Availability and Changes to the Service

We aim for reliable availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue any part of the Service, including specific stories. If we discontinue the Service entirely, we will give at least 30 days notice to users with unused coins and provide reasonable compensation (for example, refunds for unused coins where permitted by law and payment-provider rules).

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. ALL STORIES AND AI-GENERATED CONTENT ARE FICTIONAL; RESEMBLANCE TO REAL PERSONS OR EVENTS IS UNINTENTIONAL UNLESS STATED OTHERWISE.

12. Limitation of Liability

• To the maximum extent permitted by law, our total liability arising from or related to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) USD 50.
• We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost goodwill.
• Consumer rights: Nothing in these Terms excludes or limits liability that cannot be excluded by law — including liability for death, personal injury, fraud, or gross negligence, and statutory consumer rights (e.g., EU/UK consumers keep their legal guarantees for digital content).

13. Termination

• You may stop at any time: delete your account in settings or email us. Upon deletion, your personal data is removed per our Privacy Policy, and content you published is deleted (except copies required by law).
• We may suspend or terminate accounts that violate these Terms, fail to pay amounts due, or create risk or legal exposure for us. Where reasonable, we will notify you and give you a chance to remedy the issue first.
• Sections 4 (purchased licenses), 8 (IP), 11 (disclaimers), and 12 (liability) survive termination.

14. Governing Law and Disputes

These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law rules. Nothing here deprives consumers of the protection of mandatory consumer-protection rules in their country of residence.

Before initiating formal proceedings, we ask both parties to attempt good-faith resolution by contacting q171005@163.com first — most issues can be resolved directly. If you are a consumer in the EU/UK, you may also use your local alternative dispute resolution (ADR) or Online Dispute Resolution (ODR) mechanism.

15. Changes to These Terms

We may update these Terms. The "Last Updated" date at the top reflects the current version. For material changes we will notify you through the Service at least 14 days before they take effect (for example, changes to payment or refund terms). Continued use after the effective date constitutes acceptance.
